Where an appeal is for a place in reception, year 1 or year 2, and that place has not been offered because of the legal limit of 30 pupils per class, there are limited circumstances in which an appeal can be upheld. The independent appeals panel will consider:
- whether the decision was not one which a reasonable admission authority would make in the circumstances of the case
- whether the child would have been offered a place if the admission arrangements had been properly implemented
If the panel is satisfied that the above have been met then the appeal will be refused and a place will not be allocated.
