Minerals and Waste Joint Plan

City of York Council, North Yorkshire Council (NYC) and the North York Moors National Park Authority have been working together to produce a Minerals and Waste Joint Plan covering all 3 planning authority areas.

The new Joint Plan will help the 3 Authorities take decisions on planning applications for minerals and waste development over the period up to 31 December 2030.


Adoption of the Minerals and Waste Joint Plan

Following the receipt of the Inspectors Report and Appendix of Main Modifications on 4 February 2022, City of York Council, North Yorkshire Council and the North York Moors National Park Authority, have progressed the Plan to adoption. North Yorkshire Council adopted the Plan on 16 February and North York Moors National Park Authority adopted the plan on 21 March.

The City of York Council agreed to adopt the Minerals and Waste Joint Plan at its Full Council meeting on 27 April 2022, following the Local Plan Working Group on 7 March 2022 and Executive on 17 March 2022.

An Adoption Statement has been issued under Regulations 26 and 35 of the Town and Country Planning (Local Planning)(England) Regulations 2012 (as amended) and Planning and Compulsory Purchase Act 2004 (as amended).

Background to the Minerals and Waste Joint Plan

The City of York Council, North Yorkshire Council and North York Moors National Park Authority received the Inspectors Report and Appendix of approved Main Modifications on 4 February 2022.

The Inspectors Report found the Minerals and Waste Joint Plan and supporting documents ‘sound’, subject to the Main Modifications.

Each of the 3 Authorities can now progress and adopt the Minerals and Waste Joint Plan.

Main Modification Consultation - July to September 2021

The Main Modification Consultation took place for 8 weeks between Wednesday 21 July and Wednesday 15 September 2021.

Documents were made available to view at City of York Council’s West Offices, York, North Yorkshire County Council’s County Hall, Northallerton and at North York Moors National Park offices, Helmsley. Posters advertising the consultation were also available in all York libraries.

Examination of the Minerals and Waste Joint Plan

Following Submission of the Plan, an independent Inspector and Programme Officer were appointed to undertake Examination of the Joint Plan.

Examinations Hearing Sessions commenced in February 2018 following Submission of the Plan. The Examination was undertaken in phases.

Submission of the Minerals and Waste Joint Plan

Notice was given, in accordance with regulation 22(3) of the Town and Country Planning (Local Planning) (England) Regulations 2012, that North Yorkshire Council, City of York Council and North York Moors National Park Authority have submitted their Minerals and Waste Joint Plan to the Secretary of State for Communities and Local Government on 28 November 2017.

The Minerals and Waste Joint Plan Examination was made available for inspection on the North Yorkshire Council website or in hard copy at:

  • North Yorkshire Council
  • City of York Council
  • North York Moors National Park
  • District and Borough Council Offices
  • all libraries in the Plan area

What is included in the Plan

The Minerals and Waste Joint Plan includes:

  • the approach the 3 authorities would like to take in making decisions on future minerals and waste-related development
  • guidelines for where, when and how much minerals and waste related development should take place in the plan area
  • policies for each mineral type and the different types of waste produced in the area
  • specific policies relating to development management issues, such as transport, protection of the environment and communities
  • a number of sites which are considered suitable in principle, subject to necessary planning permission, for future minerals and waste development

Previous stages of consultation

The first consultation stage took place in May and June 2013. We presented initial information about the Plan and sought views on what the Plan should contain.

The 'Issues and Options' consultation took place in Spring 2014. We received comments on policies and potential allocations as well as further sites and information being submitted.

We ran a supplementary sites consultation during March 2015 which gave residents the opportunity to comment on new sites and information submitted during the previous stage.

We sought views on our 'Preferred Approach' via our Preferred Options Consultation between November 2015 and January 2016. The outcomes of this consultation have fed into our draft Joint Plan Publication.

We ran our Publication Consultation between 9 November and 21 December 2016. The responses we received at this stage have fed into our 'Proposed Changes' consultation document.

We also consulted on our 'Addendum of Proposed Changes' to the Publication draft Minerals and Waste Joint Plan between 12 July and 6 September 2017.

Our statutory responsibility for minerals and waste policy

We have a statutory responsibility to plan for future minerals and waste policy as set out in the Localism Bill.

We are helping to meet our Duty to Co-Operate by preparing this plan in partnership with North Yorkshire Council and the North York Moors National Park Authority.
